Henne Moments Sweepstakes: Terms & Conditions

1. Eligibility:This Henne Moments Sweepstake (the “Campaign”) is open only to those who comply with Section 4 of this disclaimer. All entrants must be 18 years of age or older as of the date of entry. The Campaign is open to legal residents of eligible countries and states, and is void where prohibited by law. Employees of Henne Jewelers, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations, and is void where prohibited by law.

2. Agreement to Rules:By participating, the applicant (the “Participant”) agrees to be fully unconditionally bound by these rules, and the Participant represents and warrants that the Participant meets all of the eligibility requirements of the Campaign as provided herein and on the Henne Jeweler’s website. In addition, the Participant agrees to accept the decisions of Henne Jewelers as final and binding as it relates to the content of the Campaign.

3. Sweepstake Period: The Campaign giveaways will occur once per calendar quarter. All entries must be received by 10:00 am (Eastern time) two business days prior to the giveaway date posted on https://www.hennejewelers.com/pages/henne-moments-backup to be eligible for that quarter’s giveaway.

4. How to Enter: Henne Jewelers customers may enter the Campaign in two ways. Participants may complete the online form on https://www.hennejewelers.com/pages/henne-moments-backup and fulfill the valid story requirements to be eligible to win a prize and to participate in other Campaign discounts and events. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Henne Jewelers. Each valid story entry will receive one entry per quarterly sweepstake. Participants may remove themselves from the quarterly sweepstake at any time. Participants may not enter more times than indicated by using multiple email addresses, identities, or any other devices to circumvent the rules. Duplicate entries will be deleted from the Campaign at the sole discretion of Henne Jewelers.

5. Prizes:Prizes for the Campaign will vary. The specifics of the prize shall be solely determined by Henne Jewelers prior to each quarterly sweepstake and identified on the Henne Jewelers website. No cash or other prize substitution shall be permitted except at Henne Jewelers’ sole discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner of each sweepstake (the “Winner”). No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by the Winner is permitted.

6. Odds: The odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification:The Winner will be selected by random digital drawing from all eligible Campaign entries. The Winner will be notified by email within five (5) days following selection of the Winner. Henne Jewelers shall have no liability for the Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for the Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 30 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as may be required, the prize may be forfeited and an alternate winner selected. Receipt by the Winner of the prize offered in the Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY THE WINNER (AT HENNE JEWELERS’ SOLE DISCRETION) WILL RESULT IN THE WINNER’S DISQUALIFICATION AS THE WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS THE WINNER WILL BE IMMEDIATELY TERMINATED.

8. Rights Granted by You: By submitting content toward the Campaign (e.g., photo, text, etc.), You understand and agree that Henne Jewelers, anyone acting on behalf of Henne Jewelers, and Henne Jewelers’ licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, picture, voice, likeness, statements submitted to the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

If the picture contains any material or elements that are not owned by You and/or which are subject to the rights of third parties, and/or if any persons other than You appear in the picture, You are responsible for obtaining, prior to submission of the picture, any and all releases and consents from all third parties necessary to permit the exhibition and use of all contents of the submission in the manner set forth pursuant to the terms of this Campaign.

9. Terms & Conditions:Henne Jewelers reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond Henne Jewelers’ control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Henne Jewelers may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Henne Jewelers. Henne Jewelers reserves the right, in its sole discretion, to disqualify any individual and/or remove any entry that violates or does not meet the contest rules and guidelines; Henne Jewelers reserves the right, in its sole discretion, to disqualify any individual and/or remove any entry deemed inappropriate or not in line with the best interests of the Campaign. Henne Jewelers reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. Henne Jewelers has the right, in its sole discretion, to maintain the integrity of the Campaign or remove sweepstake submissions for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such attempt be made, Henne Jewelers reserves the right to seek damages to the fullest extent permitted by law.

10. Limitation of Liability: By entering, You agree to release and hold harmless Henne Jewelers and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation and submission in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or internet service impacting the Campaign; (iv) unauthorized human intervention in any part of the entry process or the Campaign; and (v) electronic or human error in the administration of the Campaign or the processing of entries.

11. Disputes: THIS CAMPAIGN IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE COMMONWEALTH OF PENNSYLVANIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Allegheny County, Pennsylvania or the Western District of Pennsylvania. Further, in any such dispute, under no circumstances shall the Participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). You further waive all rights to have damages multiplied or increased.

12. Email Newsletter:By submitting an entry in this Campaign you agree to receive email newsletters and promotions from Henne Jewelers. You are free to unsubscribe at any time.

15. Sponsor: The Sponsor of the Campaign is Henne Jewelers located at 5501 Walnut Street in Pittsburgh, PA 15232.

16. Trademarks:All trademarks used by the Campaign are the property of their respective owners. The manufacturers of the prizes offered in this Campaign do not sponsor or endorse this Campaign in any way.

17. Social Media: This Campaign is no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Twitter. You understand that You are providing the information to Henne Jewelers and not to Facebook, Instagram or Twitter. By participating in this Campaign, You agree to a complete release of Facebook, Instagram and Twitter from any claims.
